With 35 years of experience, Frédéric is an international consultant in all aspects of intellectual assets management and commercialization.

He has held former positions as Deputy General Manager of the French Patent Office, Director of the Licensing and Business Development Department for L’Oréal.

Frédéric is a medical doctor and holds a Ph.D. in Genetic Engineering from the Pasteur Institute of Paris and a postgraduate degree in Strategic Management from HEC School of Management.

Dear Prof. Caillaud! Thank you for an interesting presentation on 'IP marketing: Finding partners'. I strongly support the idea about the importance of know-how in technology transfer. Could you please share your experience regarding the carear development in the area of Licencensing. To be more specific, is there are some perspectives for an independant expert in licensing? There is not much market for licensing in my area, so I'm looking for freelancing remotely, from Ukraine. Thank you in advance!

Les autorisations départementales sont présentes principalement dans la maison mère des grandes entreprises ou dans certaines de leurs filiales, ainsi que dans les organismes publics de recherche. Il est cependant tout à fait possible de lancer une activité indépendante pour aider les entreprises et les universités à mieux valoriser leurs inventions. Pour ce faire, il faut rencontrer les universités et les entreprises de votre pays en leur proposant vos services. Vous pouvez proposer vos services à des entreprises étrangères ou opérant à l'étranger mais il vous faudra leur montrer un ou 2 cas de réussite pour les convaincre. La licence est généralement internationale. Si l'invention est de bonne qualité et brevetée, votre activité sera très internationale et vous pourrez conduire votre bureau. Dans le contexte actuel,

Dr. Caillaud, here are the questions that we could not have answered during the webinar:

1. If you have diagnosed ,analysed the risks ,managed your environment of utilising your Licences is it simple to collaborate it with patents as there are billions of them and are different? If so, what are the implications of the web?

2. How do you make a national map for a country where patent information is not available in full in international systems like Questel? How do you study the market in that case? Thank you 

3. Must your ideas or innovations be 100% novel for them to be patented?

In order to proceed with a licensing project or a partnership, you need to check the freedom to operate. Other companies or universities may have filed patent applications prior to your application and with a broader scope. Therefore, it might prevent you to proceed with your licensing project without an agreement negotiated with the owner of the first filed patent. In order to prevent this problem, it is simple. you must ask you IP attorney to conduct a prior art study and ask him to determine if the freedom to operate is OK. Very oftenly, it is not clear cut and you will have to carefully discuss with your patent attorney. Checking freedom yo operate is one of the key question prior to initiating a partner research.

If the list of patents of a specific country is not available in your data base, you must check other data bases. The most comprehensive one is called IFI . If it is not available, you must contact the patent office of the country. In most cases, they will probably be able to provide you with the list of patents that you are looking for. In most cases, the patent will require an understanding of the national language. Sometimes, the summaries might be in English. When the list is available you can make a map of the technology available in this specific country with Clarivate analytics (but it needs at least 2000 patent applications). In order to create a classical worldwide map of technologies, you must have to translate in English your entire national set of patent. The best approach would be to ask you patent office to do the job and to transfer the data to data base owners like Questel, IFI, Derwent and others. Some of them are starting to do it.

One of the key criteria to deliver a patent is novelty. If your invention have already been described or provided to the public it is impossible. Nevertheless, the level of inventiveness can be rather law. Check the prior art and identify a feature that was not previously described . if it is new, you might be able to get a  narrow scope patent. Be careful and weight the patenting cost versus your return of investment as it is usually very difficult to extract money  from this type of patent. Nevertheless, some companies are doing it in order to increase the number of patents in their portfolio in order to claim an innovative image based on the quantity of filed patents.
