Subject: Expert Determination on Legality, Technical Viability, and Non-Response Regarding Intellectual Property Collateralized Debt Obligations (IP CDOs)
I. Basis for Request
Pursuant to Article 3(a) of the WIPO Expert Determination Rules, this Request seeks binding determination on:
"The legal classification, technical feasibility, and institutional obligations concerning IP CDOs as novel financial instruments leveraging intellectual property assets under international IP frameworks."
II. Procedural Grounds
Repeated Non-Response:
Evidence of formal submissions to WIPO (2024–2025) regarding IP CDOs, including:
Economic impact analyses
Zero substantive replies received, contravening WIPO’s mandate to promote "efficient global IP infrastructure" (WIPO Convention, Article 3).
Systemic Implications:
Suspected institutional bias against blockchain-based IP monetization models, evidenced by:
WIPO’s public disregard of digital (blockchain) IP financing (e.g., 2024–2025 Program Focus: "Copyright in the Digital Age").
Lack of engagement despite alignment with WIPO’s own data on intangible asset underutilization.
III. Questions for Determination
The Expert Panel is requested to rule on:
Legal Status:
Do IP CDOs are comply with the policy of IP Financing?
Technical Viability:
Does blockchain tokenization of IP assets (e.g., patents, copyrights) for debt securitization comply with WIPO standards?
Institutional Obligations:
Does WIPO’s silence on IP CDOs violate its statutory duty to facilitate IP innovation under Article 4 of the WIPO Convention?

Annex A: Documentation of IP Bonds/IP CDOs with comparative analysis of IP CDOs vs. WIPO-promoted IP financing models.
V. Proposed Expert Qualifications
The Requestor proposes Experts with expertise in:
Blockchain-based IP monetization,
Structured finance (CDO/ABS markets),
WIPO-administered treaties (e.g., PCT, Berne Convention).
VI. Request for Relief
A binding declaration that IP CDOs:
Qualify blockchain IP Finance as protectable mechanism under international law.
Merit formal evaluation by WIPO’s Advisory Committee.
Mandate WIPO to:
Issue a substantive response within 30 days.
Establish a Task Force on Blockchain IP Finance.
